Acceptance of Terms

By downloading, installing, or using Penny Pilot (available on the App Store as "Penny Pilot: Expense Tracker", referred to in these Terms as the "App", you agree to these Terms of Use. If you do not agree, please do not use the App. These Terms form an agreement between you and Babak Ramazanilar ("we," "us," or "our"), the publisher of the App.

You must be at least 13 years of age to use Penny Pilot. If you are under 18, you confirm that you have your parent or guardian's permission to use the App and agree to these Terms on your behalf.

License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device you own or control, solely for your personal, non-commercial use, in accordance with Apple's Standard End User License Agreement and these Terms. Apple's Standard End User License Agreement is available here.

You acknowledge that this license is between you and Babak Ramazanilar only, and not with Apple. Apple is not responsible for Penny Pilot or its content and has no obligation to provide any support or maintenance for the App.

You may not copy, modify, reverse-engineer, distribute, or create derivative works based on the App, except as permitted by applicable law.

Intellectual Property

Penny Pilot, including its name, design, code, graphics, and content, is owned by Babak Ramazanilar and protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of any part of the App. All rights not expressly granted in these Terms are reserved.

Your Data and Responsibility

Penny Pilot stores all of your data, including transactions, wallets, budgets, attachments, and settings, locally on your device. Because we do not collect, sync, or back up this data ourselves, you are solely responsible for backing up your own data, for example through your device's own backup systems.

If you delete the App, lose your device, or otherwise lose access to your device's storage, your data may be permanently lost unless you have made your own backup. We are not responsible for any loss of data resulting from device loss, damage, deletion of the App, or operating system issues.

Subscriptions and Purchases

The App offers an optional Pro subscription (monthly or yearly) and an optional one-time Lifetime purchase, each unlocking additional features as described within the App. All purchases are billed and processed entirely through Apple's App Store, in accordance with Apple's own terms and payment systems.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period, in accordance with Apple's standard subscription terms.
• You can manage or cancel your subscription at any time through your device's App Store account settings.
• Refunds are handled by Apple in accordance with Apple's refund policies. We do not have the ability to directly process refunds ourselves.
• Subscribers who purchase a subscription during a promotional or launch pricing period will retain that price for as long as their subscription remains active without interruption, even if the standard price for new subscribers later increases. This pricing guarantee does not apply if a subscription lapses and is later restarted at the then-current price.

Tips and Support the Developer

The App offers an optional tip feature allowing you to voluntarily support the developer. Tips are entirely optional, do not unlock any additional features, and are non-refundable except where required by law or Apple's policies.

No Financial Advice

Penny Pilot is a personal expense tracking tool intended to help you record and review your own financial activity. It does not provide financial, investment, tax, or legal advice. Any insights, summaries, or statistics generated by the App, including AI-generated insights, are descriptive observations about the data you have entered, not professional advice or recommendations. You should consult a qualified professional before making financial decisions.

Disclaimer of Warranty

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of, or inability to use, the App, even if we have been advised of the possibility of such damages.

Changes to the App

We may modify, update, suspend, or discontinue the App, or any feature within it, at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the App or any of its features.

Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to the App if you violate these Terms, to the extent technically applicable given the App's offline, account-free design.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Manitoba, Canada, without regard to its conflict of law principles, except where applicable consumer protection laws in your own country of residence provide otherwise. Any disputes arising under these Terms will be resolved through good-faith negotiation before pursuing formal legal action.

Changes to These Terms

We may update these Terms from time to time. Continued use of the App after any changes constitutes your acceptance of the updated Terms. The "Last updated" date at the top of this page reflects the most recent revision.
